General Terms and Conditions
1. scope of application / components
The following General Terms and Conditions apply to all services provided by Kongresshaus Zürich AG within the framework of a valid contract between you and Kongresshaus Zürich AG. These General Terms and Conditions form an integral part of the contract and supplement it. In the event of any contradictions, the contractual agreement shall take precedence over the provisions of these General Terms and Conditions.
All users must comply with the House Rules & of Kongresshaus Zürich AG. Kongresshaus Zürich AG provides an organizer's manual, which in part contains information sheets of great importance. The tenant must ensure that the relevant persons are aware of these and comply with them.
2. reservation of written form
All agreements with Kongresshaus Zürich AG must be made in writing in order to be valid. Amendments and/or additions to the contract can also be agreed by e-mail.
3 Binding nature / conclusion of contract
The Kongresshaus Zürich AG may cancel an event in the event of serious political or economic events, mandatory official orders, important reasons which make the continuation of the contractual relationship appear unreasonable for the Kongresshaus Zürich AG and in the event of force majeure. In such cases, Kongresshaus Zürich AG shall not be liable. Payments already made will be refunded.
4. terms of payment
4.1 Prices
All prices are quoted in Swiss francs (CHF). The statutory value added tax is shown accordingly.
4.2 Terms of payment
Unless otherwise agreed, Kongresshaus Zürich AG invoices are payable within 10 days of the invoice date.
If this deadline is not met, the tenant shall be in default and Kongresshaus Zürich AG shall be entitled to charge a reminder fee of 5% of the invoice amount.
4.3 Offsetting
No discount is granted for timely payment of the invoice. In principle, invoices are not issued to third parties.
5 Access rights / right to issue instructions
The responsible persons of Kongresshaus Zürich AG must be granted access to the rented premises at all times so that inspections regarding compliance with safety regulations etc. can be carried out. Kongresshaus Zürich AG is entitled to issue and enforce instructions to anyone.
6 Liability for third-party damage / insurance
The lessee shall be fully liable for damage caused by its employees and auxiliary persons as well as by third parties such as visitors, exhibitors, drivers, stand construction companies and other contracting parties of the lessee.
The premises shall be handed over to the Lessee before the start of the event. This handover is usually recorded. Any damage to the premises, furniture and all equipment must be reported immediately. Upon return of the rented property, all damage incurred shall be recorded in a jointly drawn up report. This must be signed by both parties and forms the basis for claims for damages on the part of Kongresshaus Zürich AG.
The Kongresshaus Zürich AG declines all liability for incidents during the event (damage to property, personal injury, theft, etc.). In particular, it is not liable for damage of any kind or loss of exhibits, furnishings and personal belongings of users and visitors.
Insurances of all kinds are the responsibility of the tenant.
7. exclusion / reprimand
In the event of presentations of legally unauthorized goods, unlawful publications or the performance of other unlawful acts in the rented premises, Kongresshaus Zürich AG reserves the right to remove or expel such goods and their representatives from the premises of Kongresshaus Zürich / Tonhalle Zürich at the expense of the tenant.

8. Complaints
If, in the tenant's opinion, the services provided by Kongresshaus Zürich AG do not comply with the contractual agreements, the tenant must report this as soon as possible and in any case during the event. Late complaints will no longer be considered and will not give rise to any claims.
9. Safety
9.1 Occupational safety
The Lessee shall ensure the safety of its employees, auxiliary persons and contractors within the framework of the applicable accident prevention regulations.
9.2 Keeping escape routes clear
Access routes, passages and entrances to exits and emergency exits must not be obstructed or occupied by additional chairs

No decorations may be placed in the corridors, stairwells and all escape routes. In particular, exits, extinguishing equipment, fire alarm and sprinkler systems, escape signs and safety lighting must not be covered or blocked by decorations.
Fire safety defects that are the subject of complaint must be rectified in accordance with the instructions of Kongresshaus Zürich AG or the authorities. Any costs shall be borne by the tenant.
9.3 Compliance with maximum occupancy
Too many people in one room pose a safety risk. The maximum permitted number of persons in the rooms or sub-rooms must therefore not be exceeded. The tenant must strictly adhere to the maximum number of people permitted
No chairs may be set up in addition to the approved seating capacity.
If persons in wheelchairs take part in the event, the approved seating must be reduced by the number of wheelchairs.
The wheelchairs must be placed in the spaces provided for them.
Accompanying persons of wheelchair users must also purchase tickets or the number of tickets available for sale must be reduced by the number of accompanying persons.
Wheelchairs and walking aids may not be placed in the escape routes and corridors.
9.4 Fire protection, pyrotechnics, decoration
Smoking is strictly prohibited throughout the building. Open fires, handling flammable liquids or gases and the like are strictly prohibited throughout the building.
Exceptions require a special permit from the Zurich fire police in all cases. This must be obtained by the tenant in good time and submitted to Kongresshaus Zürich AG at least 4 weeks before the event.
The pyrotechnic equipment must be approved by the fire police in good time before the event.
All legal and fire police regulations apply to the use of decorations.

9.5 Fire police
It may be necessary to deploy the fire police of the City of Zurich for stage and major events. The tenant is generally responsible for their deployment and must bear the costs. In the event of failure to do so, Kongresshaus Zürich AG shall call out the fire police of the City of Zurich, whereby the costs shall be borne by the tenant.
9.6 Fog and haze
The use of artificially generated fog or haze requires the fire alarm system's detection lines to be deactivated. The tenant is obliged to request the possibility of using fog or haze at least 14 days in advance. Kongresshaus Zürich AG will then immediately clarify whether it is possible to use them. The costs of any compensatory measures that become necessary for the decommissioning of signal lines shall be borne by the tenant.
9.7 Lasers and other non-ionizing radiation
The use of lasers and non-ionizing radiation is subject to all legal and fire regulations of the City of Zurich. Their use requires a permit.

The structures and equipment must be inspected and approved by the scientific service of the Zurich City Police.
9.8 Noise protection provisions
The tenant undertakes to comply with the statutory provisions and regulations and to indemnify Kongresshaus Zürich AG against any liability.
The lessee shall provide visitors with sufficient hearing protection equipment at its own expense if required and, at the request of Kongresshaus Zürich AG, provide evidence of the noise exposure during the event.
The information sheet on noise protection from the organizer's handbook refers in particular to the levels to be observed.
9.9 First aid
The relevant specialist personnel from a partner of Kongresshaus Zürich AG is subject to a charge and is always ordered by Kongresshaus Zürich AG. The first-aid room in the building is available free of charge. For events with 650 persons or more, the use of two first-aid personnel is obligatory. The price per person and hour will be charged. Non-compliance with this requirement is only possible in exceptional cases with the written approval of Kongresshaus Zürich AG.
9.10 Security personnel
The security personnel required from a partner of Kongresshaus Zürich AG is subject to a charge and is generally ordered by Kongresshaus Zürich AG. The price per person and hour will be charged. Non-compliance with this requirement is only possible in exceptional cases with the written approval of Kongresshaus Zürich AG. The number of persons will be determined by Kongresshaus Zürich AG according to the event.
9.11 Security personnel for children
The operators and tenants of the building complex and Kongresshaus Zürich AG will exert greater influence on the use of the venue to ensure that children are looked after and supervised by their parents/guardians, particularly at family concerts/events, and that school classes are looked after and supervised by their teachers at school events.
Organizers are made aware in particular of the risk of unattended children falling and are contractually obliged to provide sufficient supervisory staff to supervise children of pre-school age. In the case of Kongresshaus Zürich AG's own events, the company undertakes to ensure supervision.
10. official authorizations
All special official permits issued by the City of Zurich must be obtained by the tenant in its own name. It is responsible for compliance with the statutory provisions and police regulations.
A copy of the permits must be submitted to Kongresshaus Zürich AG at least 14 days before the event.
If a claim is made against Kongresshaus Zürich AG by the authorities for violation of legal provisions or police regulations and/or for failure to obtain a permit, the tenant shall indemnify Kongresshaus Zürich AG in full against all claims and bear the legal costs incurred in defending against the claim.
11. Use of stages and ancillary rooms
Stages and ancillary rooms may only be used in the presence of the responsible staff of Kongresshaus Zürich AG and the authorized partner. Only the relevant Kongresshaus Zürich AG personnel are authorized to operate the stage equipment. Their instructions must be followed. Kongresshaus Zürich AG accepts no liability whatsoever for accidents and damage caused by failure to observe these regulations.
12. External technology and external companies
The use of third-party technology in the Kongresshaus Zürich and the Tonhalle Zürich must always be approved in advance by the authorized partner of Kongresshaus Zürich AG.
The use of in-house facilities and equipment, e.g. elevators, connections to energy and pipelines, lifting equipment and means of transport by external companies must be approved by Kongresshaus Zürich AG.
The information sheet on external companies in the Kongresshaus Zürich AG organizer's manual must be observed. The tenant must ensure that the external companies comply with all specifications of Kongresshaus Zürich AG.
13 Rigging
Rigging in the Kongresshaus Zürich and the Tonhalle Zürich is subject to the generally recognized rules of technology, which must be observed at all times. Important information on this can be found in the Kongresshaus Zürich AG organizer's manual.
Access to the roof and suspended ceilings is only possible when accompanied by personnel from the authorized partner of Kongresshaus Zürich AG. Predefined suspension points above the event areas may only be used after approval by the authorized partner of Kongresshaus Zürich AG. Written proof of the intended load must be provided. This may not be exceeded under any circumstances.
14. checkrooms for the public
The public checkrooms are generally operated by Kongresshaus Zürich AG staff for a fee. The costs are either charged to the tenant or to the users of the public checkrooms via checkroom fees. At the request of Kongresshaus Zürich AG, the option of charging the tenant must be used.
15. hospitality / catering
The setting up of catering stands of any kind is prohibited throughout the building and is generally reserved for Kongresshaus Zürich AG. Food and drinks won in a raffle, brought in by the customer or distributed free of charge may also not be consumed on the premises of Kongresshaus Zürich / Tonhalle Zürich.
Catering services by third-party companies are only possible in exceptional cases (special regimes or types of preparation) and always require written permission from Kongresshaus Zürich AG. These services can only be provided by selected partners of Kongresshaus Zürich AG.
The presence of a chef de service and a service employee from Kongresshaus Zürich AG is required both during the preparatory work and during the event.
In principle, the catering prices include the usual personnel costs and the corresponding infrastructure. In the case of catering options that require more staff than usual, for example individual collections, cloche service or staging, the additional staff hours will be invoiced additionally to the tenant.
16. advertising
Posters etc. may only be put up in the designated places for a fee. The display of posters etc. on facades, pillars, walls, shop windows, windows and passageways as well as the distribution of advertising material is generally prohibited.
17 Use of the name and logo of the Kongresshaus Zürich
The name and logo of Kongresshaus Zürich and Kongresshaus Zürich AG are protected trademarks and may not be used by the tenant without the written consent of Kongresshaus Zürich AG (e.g. on flyers, invitations, handouts, websites, etc.). A draft of the intended use of the logo must be submitted to Kongresshaus Zürich AG for approval in good time. Kongresshaus Zürich AG has a say in the graphic design.
18. data protection notice
The data provided by the tenant will be recorded electronically and stored in the Kongresshaus Zürich AG database. They are used to fulfill the contract and for analysis, information and advertising purposes. Any further use of the data, in particular forwarding to third parties, will not take place. Exceptions to this are forwarding to service providers working for Kongresshaus Zürich AG.
19 Photographs, videos and sound recordings
The Kongresshaus Zürich AG reserves the right to take photographs, videos and sound recordings of the event and to use these on the Kongresshaus Zürich AG website or for its own advertising purposes. If you do not agree to this, please inform us in writing in advance of your event.
20 Public events in the congress hall
The tenant is free to choose the ticketing service provider. When choosing the ticketing service provider Ticketcorner.ch (partner of Kongresshaus Zürich AG), the tenant benefits from simplifications, special services and favorable conditions.
Before advance sales start, the seating plan including possible standing room quotas and the ticket layout must always be submitted to Kongresshaus Zürich AG for inspection and approval. Ten contiguous seats in the central gallery must be kept free for Kongresshaus Zürich AG. The corresponding tickets must be made available to Kongresshaus Zürich AG free of charge at least 30 days before the event. Kongresshaus Zürich AG has the right to offer ticket upgrades (e.g. tickets including catering services) for up to a maximum of 10% of all tickets in the desired ticket category.
Security and admission control personnel are defined by Kongresshaus Zürich AG based on the type of event and must be obtained from Kongresshaus Zürich AG. Please note that the control of personalized tickets leads to increased effort and possibly longer admission times. Kongresshaus Zürich AG has the right to obtain the visitor numbers (number of all tickets including upgraded tickets, free tickets, etc.) directly from the relevant ticketing service provider.
Only ticket scanners from Kongresshaus Zürich AG are used for admission control at each event. This means that only tickets that can be read by Kongresshaus Zürich AG ticket scanners may be sold, so that information about the tickets scanned and thus the visitors present can be provided at all times.
21 Final provisions
By entering into a contract with Kongresshaus Zürich AG, for which the lessee has received the General Terms and Conditions before signing, the lessee is responsible for ensuring that its employees, auxiliary staff and contractors are also aware of and comply with the General Terms and Conditions.
Agreements deviating from the General Terms and Conditions must be made in writing to be valid.
Should these provisions be partially legally invalid or unenforceable, this shall not affect the validity of the remaining provisions. In this case, the invalid provision shall be replaced by a legally valid provision that comes closest to the original intention of the invalid provision.
The exclusive place of jurisdiction for all disputes, including international disputes, is the Commercial Court of Zurich (location of the rental property). Swiss law shall apply to the exclusion of the conflict of laws provisions and the Vienna Sales Convention.
For questions of interpretation, the German version shall take precedence over any translations.
